Touted respects the intellectual property rights of others and desires to offer an application and Services which contains no content that violates those rights. Our Terms of Service require that information posted by Users (as defined by our Terms of Service) be accurate, lawful, and not in violation of the rights of third parties. To promote these objectives, Touted provides a process for submitting complaints concerning content posted by our Users. Our complaint policies and procedures are described in the sections that follow.

Please note that we reserve the right to disable access to or remove content, in our sole discretion, that we believe may infringe on the intellectual property rights of others or otherwise violate our Terms of Service. We may also make a good faith attempt to forward the written notification, including the complainant’s contact information, to the User who posted the content or take other reasonable steps to notify our Users that Touted has received notice of an alleged violation of intellectual property rights or other content violation. In appropriate circumstances and at our discretion, it is also our policy to disable and/or terminate the accounts of Users who infringe or repeatedly infringe on the rights of others or otherwise post unlawful content.

Any copyright infringement notice or counter-notice you submit must be truthful and must be submitted under penalty of perjury. A false notice or counter-notice may give rise to personal liability. Therefore, you may want to seek legal counsel's advice before submitting a notice or a counter-notice.

Claims Regarding Copyright Infringement
Notice of Copyright Infringement. According to the Digital Millennium Copyright Act (17 U.S.C. § 512), Touted has implemented procedures for receiving written notification of claimed infringements. Touted has also designated an agent to receive notices of claimed copyright infringement. If you believe your copyright, trademark, or other property rights have been infringed by any content on our Platform, you, or the content owner, should immediately notify us (as identified below). To be effective, the notification must include:

  1. Identify the material that you claim is infringing upon your copyrighted work
  2. Your contact information, including an email address
  3. Enough information, if possible, to permit us to notify the owner of the allegedly infringing material or other content
  4. Include the following statement: “I have a good faith belief that use of the copyrighted materials described above as allegedly infringing is not authorized by the copyright owner, its agent, or the law.”
  5. Include the following statement: “I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”
  6. Sign the notice

  • Upon receipt of a Copyright Infringement Notice, Touted will remove or block public access to the allegedly infringing content as soon as possible. We will then notify the allegedly infringing party that an infringement notice was submitted regarding their content on the App. 

    Counter-Notice. If you believe that a notice of copyright infringement has been improperly submitted against you, you may submit a Counter-Notice, pursuant to Sections 512(g)(2) and (3) of the Digital Millennium Copyright Act. To submit a Counter-Notice, your notice must contain:
    1. A physical or electronic signature of the Registrant. 
    2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled. 
    3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled because of a mistake or misidentification of the material to be removed or disabled. 
    4. Your name, address, and telephone number. 
    5. The following statement: “I consent to the jurisdiction of the Federal District Court located in Georgia, and that I will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person. 
    6. The following statement: “I swear, under penalty of perjury, that I have a good faith belief that the affected material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.”

    Upon receipt of a counter-notice, Touted will wait fourteen (14) days before determining whether to reactivate the claimed infringing content. However, we may choose not to reactivate any content at our sole discretion and will have no liability for not reactivating any content.
