This Privacy Policy governs how Touted, LLC (“Touted”, “we”, “us”, or “our”) collects, uses, maintains, and discloses information collected from Users (each, a “User”, “you” or “your”) of our website www.toutedapp.com, as well as any affiliated websites, widgets, tools, software, or mobile applications, related, linked, owned, operated or otherwise controlled by Touted (collectively, the “Services”). 

Touted is committed to protecting your privacy. Please read our Privacy Policy carefully to understand how we collect, use, protect, or otherwise handle your personal information. 

This Privacy Policy is intended to inform you of our policies regarding the collection, use, and disclosure of your Personal Information when you use our Services and the choices you have associated with that data. 

Both personal and non-personal data and information collected are safeguarded according to the highest privacy and data protection standards adopted worldwide. Specifically, for US residents, this Privacy Policy is intended to comply with the California Consumer Privacy Act 2018 (CCPA).

By using our Services, you agree to the collection and use of your Personal Information under this policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Service.

We reserve the right to change this Privacy Policy. We will notify you when material updates are made to give you an opportunity to withdraw previously given consent or to deny further use of your data. We collect Personal Information you voluntarily provide us when you express an interest in obtaining information about us or our Services, when you use our Services, or otherwise when you contact us. The Personal Information we collect depends on the context of your interactions with us and our Services, the choices you make, and the Service features you use. 

2. 2.1 Definition of Personal Information. “Personal Information” means information that can be used to identify you as an individual, such as:

Personal Data - your name, email, mailing address, phone number, and – if you are the parent or guardian of a minor - your student’s name, email, home address, age, weight, height, school, and the sports the student plays in school.

Account Registration Data - information you provide to register for an account on our Services or sign up to use our Services, such as your username and password.

Marketing Data - the email address or contact details we use to send marketing communications and your preferences for receiving communications about our activities, events, and promotions.

Device Data - information about the mobile or internet service provider you use with your device to access the Services, including name and IP address.

Messages - the date, time, and content of any messages you send us.

Web Analytics - information from our website and mobile application interactions, referring webpages and sources, and statistics on interactions between your device or browser and our Services.

2.2 Information We Receive from Other Sources. Sometimes, we receive your information from third parties (other individuals, marketing services, our transaction processors, and other third-party integrations), which may include:

Information processed from third-party integrations you set up with us. For example, a third-party integration may give us access to data stored in that third party, which we will process to facilitate the integration.

Information about you provided to us from other individuals or Users of our Services.

2.3 Location Information. We may also collect certain location information if you have instructed your device to send such information via its privacy settings or, for example, if you have uploaded content tagged with location information.
2.4 Information About Others. We may also collect, where you have provided it, information about other Users, including their email addresses and other Service-related information. 
2.5 User Content and Behavior Information. We process the content you upload, post, or share through our Services (“User Content”), including preferences you set (such as language selection), photos, audio, and video you upload or share, and comments you post. We collect User Content through preloading when you create, import, or upload User Content, regardless of whether you choose to save or upload it, to provide personalized recommendations.

We may collect information about the images and sounds that are part of your User Content, such as identifying the presence and location of displayed objects, landscapes, and faces in images and physical characteristics-qualities, characteristics of sounds, and the text of words spoken within your User Content. We collect this information to enable content recommendations and other non-personally identifiable tasks.

We may access content (including text, images, and video) on your device’s clipboard with your permission. For example, if you choose to initiate content sharing with a third-party platform or paste content from your clipboard into the Touted App, we will access the information stored on your clipboard to carry out your request.

We may also collect information about your use of our Services (e.g., the content you view, the videos you watch, how you respond to problems you encounter, the content you prefer, the content you save to your “favorites,” the Users you follow, and how you interact with other Users). Based on this information, we may also make assumptions about your interests, gender, age, and other information about you to personalize content.

We may process information about your followers, the number of “likes” you receive, and responses to content you upload to spread your content to other Users and to investigate whether your profile has further potential for collaboration.

2.6 Comments. We collect information about you when you send, receive, or engage with comments in connection with our Services. We may also use automatic scanning technology on comments to support and protect our website and App. For example, we may use this technology to manage or block content that violates our Terms of Service or community guidelines.
2.7 Passively Collected Information. We automatically collect standard Google Analytics data when you visit, use, or navigate our Services. This information does not reveal your specific identity (like your name or contact information). Still, it may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily used to maintain the security and operation of our Services and for our internal analytics and reporting purposes.
2.8 Cookies and Other Electronic Technologies. When you visit our website or use our Services, our web server sends a cookie to your computer or mobile device. Cookies are small pieces of information issued to your computer or mobile device when you visit a website or access or use a mobile application that stores and sometimes tracks information about your use of the website or Services. Some cookies we use last only for the duration of your web or application session and expire when you close your browser or exit the application. Other cookies are used to remember you when you return to the website and will last longer.

We set some cookies used by our website and Services, and some are set by third parties who deliver services on our behalf.

If you access our Services through a mobile device, you can also update your privacy settings on your device by setting the “Limit Ad Tracking” and Diagnostics and Usage setting property located in the settings screen of your Apple iPhone or iPad or by resetting your Android ID through apps available in the Play Store. 

2.9 Social Login Information. Our Services may allow you to register and log in using your third-party social media account details (like Google or Facebook logins). Where you choose to do this, we will receive certain profile information from your social media provider. The profile information we receive may vary depending on the social media provider concerned, but it will often include your name, email address, friends list, and profile picture, as well as other information you choose to make public on such platform.

We will use the information we receive only for the purposes described in this Privacy Policy or that are otherwise made clear to you regarding the Services. Please note that we do not control, and are not responsible for, other uses of your Personal Information by your third-party social media provider. We recommend that you review their privacy policies to understand how they collect, use, and share your Personal Information and how you can set your privacy preferences on their sites and apps.

2.10 Other. Because we are constantly working to improve our Services, we may need to collect new information. If we collect materially different personal data or materially change how we collect, use, or share your data, we will notify you and may also modify this Privacy Policy.
3. How We Use Your Information

We use and collect your Personal Information for the following purposes:

3.1 For the Provision of Our Services. Touted uses your Personal Information to (i) provide, operate, and improve our Services; (ii) provide information about our Services; (iii) establish and maintain your User account on our Services; (iv) enable security features of the Services, such as sending you security codes, and remembering devices from which you have previously logged in; and (v) to understand your needs and interests, and personalize your experience with the Services. 
3.2 For Relationship Management and Marketing. Touted may use your Personal Information to send you newsletters and Touted-related marketing communications as permitted by law and to update you on developments within Touted or our affiliated entities. We also use your Personal Information for the development, execution, and analysis of market research and marketing strategies. We may also analyze your use of our Services to improve the Services and develop new features, including studying User demographics and the Service’s use. 
3.3 To Display Advertisements. We may work with advertising partners to display advertisements on the Services. Our advertising partners deliver these advertisements and may be targeted based on your use of the Services or your online activity. 
3.4 To Provide Customer Support. We want to offer you the best experience possible when using our Services. When you contact us, we will use your Personal Information to answer your questions or handle your complaint. 
3.5 Improve our Services. We may use your information for analytical purposes and to improve our Services, including providing you with a tailored/optimized experience by grouping Users based on, for example, usage, interests, and demographics.
3.6 Individualization and Customization. We may notify you about special offers and services available from us, our affiliates, or our partners that may interest you. We may also use your information to tailor your experience by making inferences about your interests and preferences based on your activity and customizing the ads shown to you both on and off our Services.
3.7 Communication. Touted uses your Personal Information to (i) communicate with you or facilitate communication between you, other Users, our partners, and affiliates; (ii) conduct, monitor, and record your interactions with us; for example, your communications with our customer service team, or through our use of pixels and similar technologies to monitor how you interact with our emails to you, such as whether you open or click on content in our emails; (iii) host your comments and other content, and (iv) respond to your questions and comments.
3.8 To Post User Testimonials and Feedback. We may receive testimonials and comments from Users who have had positive experiences with our Services. We occasionally publish such content. When we publish this content, we may identify our Users by their first and last name, first name and last initial only, or username and may indicate their affiliated organization. We obtain your consent before posting your name along with the testimonial. 
3.9 Provide Cross-Device Management of Your Account. For example, we may locate or try to locate the same unique Users across multiple browsers or devices (such as smartphones or tablets) or work with service providers that do this to save your preferences across devices and analyze the usage of our Services. 3.10 To Create Anonymous Data. We may create anonymous data from your Personal Information and that of other individuals whose Personal Information we collect. We turn Personal Information into anonymous data by removing information that makes it personally identifiable to you. We may use this anonymous data and share it with third parties for our lawful business purposes, including analyzing and improving the Services and promoting our business.
3.11 To Comply with Applicable Law. We may use your Personal Information to comply with applicable laws, lawful requests, and legal processes, such as responding to subpoenas or requests from government authorities. 4. Our Use of Artificial Intelligence
We may use artificial intelligence and machine learning to deliver our Services. We may use your Personal Information for the following purposes:

To enhance your User experience, keep our Services safe, and ensure a seamless transaction process.

To provide customized content recommendations based on your preferences and past activities.

To screen and monitor your activities on our App to ensure compliance with our Terms of Service.

To prevent and detect breaches of our Terms of Service, fraudulent activities, and any misuse of our Services to maintain a safe and secure platform.

To analyze patterns in User activity to enhance security measures and improve the efficiency of our Services.

To provide personalized support and assistance based on your interaction history with our Services.

Processing your Personal Information through our systems may lead to automated decisions, which are calculated using automatic processes.

We will rely on our legitimate interest to keep our Services safe and to enhance your User experience. We will not engage in automated decision-making that involves a decision with legal or similarly significant effects solely based on the automated processing of Personal Information unless:

6. How Long We Retain Your Personal Information

When we have no ongoing legitimate business need to process your Personal Information, we will either delete or anonymize it or, if this is not possible, we will securely store your Personal Information and isolate it from further processing until deletion is possible. We may need to retain Personal Information longer to comply with applicable laws, such as those relating to taxes and accounting. 

7. When and With Whom We Share Your Information

We may share your Personal Information with the following third parties and as otherwise described in this Privacy Policy or at the time of collection. 

7.1 Our Employees and Service Providers. Within Touted, our employees, contractors, agents, and directors have access to your Personal Information, but only to the extent necessary to properly perform their individual tasks. Other companies and individuals that provide services on our behalf or help us operate our Services or our business (such as transaction processing, customer support, hosting, analytics, software development and maintenance, email delivery, marketing, database management services, and risk and fraud mitigation).
7.2 Advertising Partners. When we use third-party cookies and other tracking tools, we may disclose your Personal Information to those third-party companies to help us analyze the use of the Services, display advertisements, and advertise the Services elsewhere online. 
7.3 Professionals. We may disclose your Personal Information to professional advisors, such as lawyers, bankers, auditors, and insurers, where necessary in the course of the professional services that they render to us.
7.4 Compliance. We may share your Personal Information for compliance, fraud prevention, and safety purposes. We disclose information to law enforcement, government authorities, and private parties as we believe in good faith to be necessary or appropriate to comply with the law or for compliance, fraud prevention, and safety purposes.
7.5 Business Transfers. We may sell, transfer, or otherwise share some or all our business or assets, including your Personal Information, in connection with a business transaction (or potential business transaction) such as a corporate divestiture, merger, consolidation, acquisition, reorganization, or sale of assets, or in the event of bankruptcy or dissolution. 7.6 Affiliates. We may share your Personal Information with our subsidiaries and affiliates for purposes consistent with this Privacy Policy.
7.7 Other Users of our Services. We provide functionality that allows you to disclose Personal Information to other Users of our Services or the public. For instance, you may maintain a User account with information about yourself that you can provide to other Users or your organization. You may also submit content to the Services (such as uploading pictures and videos and submitting comments), and we may display your name and username along with the content you submit. We do not control how other Users or third parties use any Personal Information you make available to other Users or the public. Once you have posted information publicly, while you can edit and delete it on our Services, you may not be able edit or delete such information once it is cached, collected, and stored elsewhere by others (e.g., search engines).
7.8 Third-Party Platforms. We may share your Personal Information with social media and other third-party platforms that you connect to our Services, such as when you use options to access our Services by logging into a social media platform. Please note that we do not control the third party’s use of your Personal Information.

8. Targeted Online Advertising Opt-Out Options

Users may opt out of receiving targeted advertising on websites through members of the Network Advertising Initiative by clicking here or the Digital Advertising Alliance by clicking here. European Users may opt out of receiving targeted advertising on websites through members of the European Interactive Digital Advertising Alliance by clicking here, selecting the User’s country, and then clicking “Choices” (or a similarly titled link). We also may work with companies that offer their own opt-out mechanisms and may not participate in the opt-out mechanisms linked above.

In addition, your mobile device settings may provide functionality to limit our, or our partners’, ability to engage in ad tracking or targeted advertising using the ‘advertising ID’ associated with your mobile device.

If you choose to opt out of targeted advertisements, you will still see advertisements online, but they may not be relevant to you. Even if you decide to opt-out, not all companies participate in these opt-out programs, so you may still receive some cookies and tailored advertisements from companies that are not listed.

9. Information Choices

You have options regarding the processing and use of your information by us. You can access, update, and even deactivate your Touted account by visiting your Touted account’s “account settings” section. In addition, you can:

Choose the way we communicate with you.

Choose not to provide us with certain information, although it may be needed to take advantage of certain features offered on our Services.

Prevent the collection of certain geolocation information (e.g., by switching off location services in your device’s settings).

Deactivate your Touted account. We may retain some information associated with your Touted account (including past transactions) for internal purposes, including backups, fraud prevention, dispute resolution, investigations, our legitimate business interests, and legal compliance for the period necessary to fulfill the purposes outlined in this Privacy Policy.

As a registered User, you can modify your marketing preferences in the Notifications section of your Touted account.

Unsubscribe from promotional messages, including emails with service-related opportunities, in any email we send.


10. Transfer of Your Personal Information

While Touted operates globally, we are headquartered in the United States. Therefore, your Personal Information may be transferred to the United States or other locations outside your state, province, or country where privacy laws may not be as protective as those in your state, province, or country. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy. By using our Services, you understand and consent to your information being transferred and processed as described in this Privacy Policy.

We value the protection of your privacy. We have implemented appropriate and reasonable technical and organizational security measures to protect your data from loss, misuse, unauthorized access, disclosure, alteration, or destruction. 

Despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties cannot defeat our security and improperly collect, access, steal, or modify your information. 

Although we will do our best to protect your personal information, transmission of Personal Information to and from our Services is at your own risk. Only access our Services within an environment that you feel is appropriate or secure.

Further, under California’s Shine the Light law, Touted Users who are California residents may request a notice identifying the categories of Personal Information we share with third parties for our direct marketing purposes.


12.2 Right to Correction. You may request any incomplete or incorrect information we may have about you to be corrected or supplemented.
12.3 Right to Delete. You have the right to ask us to delete your Personal Information. Once we receive and confirm your verifiable consumer request, we will delete your Personal Information from our records unless certain exceptions apply.

12.4 Right to Out-Out of Processing or Sharing. You can submit a request not to process your Personal Information, either temporarily or permanently. You may also request that we stop selling or sharing your Personal Information.

12.5 Right to Withdraw Consent. You also have the right to withdraw your previously granted permission to process your personal data or to object to the processing of your personal data by Touted.

12.6 Right to Non-Discrimination. We will not discriminate against you for exercising your rights.
12.7 Opt-Out of Sale. You can request to opt out of the sale of your Personal Information to a third party.
12.8 Opt-Out of Targeted Advertising. To the extent permitted by law, you can request that we stop using your Personal Information for targeted advertising by clicking on the “Cookie consent” link that may be in the footer of our website. Additionally, you can opt out of certain uses of cookies for advertising purposes by visiting www.aboutads.info/choices. Your opt-out of cookie-based tracking for advertising purposes is specific to the device, website, and browser you use; it is deleted whenever you clear your cookies or your browser’s cache.

14. Children’s Privacy

We take the privacy of minors very seriously. Our Services are designed for Users of all ages, including those under 18. When we collect, use, or share Personal Information from Users under 18, we comply with applicable laws and regulations, including the Children’s Online Privacy Protection Act (COPPA) and other relevant privacy laws.

If you are under the age of 18, we encourage you to talk with your parents or guardians before using our Services and before providing any Personal Information. No Personal Information collected from children under 18 will be used for marketing or promotional purposes, either inside or outside the Services, without the explicit consent of their parents or guardians.

Parents and guardians have the right to review, delete, or refuse the collection of Personal Information relating to their children. If you are a parent or guardian and believe your child has provided us with Personal Information without your consent, please contact us at admin@toutedapp.com. Once notified, we will take appropriate measures to remove the information and ensure it is not used for any purpose unless we are required by law to retain it.
